What social landlords must do

Phase 1 took effect on 27 October 2025 for relevant social housing tenancies in England. It covers significant damp and mould hazards and all emergency hazards. The duties fall on social landlords; contractors need a clear brief and prompt reporting so the landlord can fulfil them.[1]

For a potential significant hazard, the landlord must investigate within 10 working days of awareness. A written findings summary is generally due within three working days of the investigation concluding, with relevant safety work within five working days where a significant hazard is confirmed. For a potential emergency, investigation and any required emergency safety work must happen as soon as reasonably practicable and within 24 hours of awareness.[1]

These are different obligations with different triggers. Making safe is not necessarily the completion of preventative work. The guidance explains further-work requirements, exceptions and alternative accommodation duties.[1]

Agree the information your client needs before the visit

Our practical recommendation is to confirm the case reference, urgency, escalation contact, scope of inspection and information the client needs back. Do not assume the legal clock starts when your team receives an instruction.

After attendance, provide a clear account of findings, supporting evidence, immediate concerns and recommended next steps. Flag anything outside your competence or instruction promptly through the agreed route.

Where MouldTrace can benefit your teamKeeping observations, photographs and readings connected can reduce the work of reconstructing a visit before reporting to the client. A demonstration should confirm the workflow and features available for your team.

General information, reviewed 21 October 2026. Practical recommendations are EnerV Global’s interpretation, not additional statutory duties. Check the linked official guidance and regulations for the applicable requirements and exceptions. Product suitability and available features should be confirmed in a demonstration.
